Article 2Lenght of the stay: The tenant signing this contract for a specific length will not be able to remain in the accommodation at the end of the stay.

Article 3 – Contract officialisation:The booking becomes effective when the tenant will have sent to the owner a deposit corresponding to 25% of the total amount and a signed copy of the contract before the date appearing on the contract. A second copy of the contract has to be kept by the tenant.

The rental concluded between the two parties cannot be used by other persons except with the owner’s written approval. If this article is not respected, the contract might be null and void and the rental cancelled, the total amount of the rental will be kept by the owner.

Article 4 – Tenant cancellation:All cancellation has to be notified by registered letter or telegram to the owner.

a)     Cancellation before arrival: The deposit is not refundable. The owner may ask the total amount, if cancelling intervenes less than 30 days before the date of the holidays.

If the tenant doesn’t show up in the 24-hours following the date of arrival on the contract, it becomes null and void and the owner disposes of his gîte. The deposit is not refundable and the owner will ask for the total due amount.

b)     In case the stay is shortened:The amount of the rental remains to the owner, no refund is available.

Article 5 – Cancellation by the owner: The owner gives back all the money given by the tenant plus a compensation equalling at least the one the tenant would have given if he had cancelled at this date.

Article 7 – Payment:Payment is made when you enter the gîte.

This inventory is the only reference in case of litigation about the state of the gîte. The cleanliness of the gîte when the tenant enters will appear on the inventory. Cleaning the gîte is at the charge of the tenant during his stay and before he leaves. The amount of cleaning fees (if available) is established in the detailed page of the gîte.

Article 9 – Guarantee deposit: When the tenant arrives, a guarantee deposit (amount written on the contract) is needed by the owner. After the last inventory, just before leaving, this deposit is fully refunded except if degradations are observed. In case of shortened stay making the establishment of the inventory impossible, the guarantee deposit will be sent back to the tenant within a week.

Article 10 – Use of the accommodation: The tenant will have to ensure the quiet character of the accommodation and use it as it should be.

Article 11 – Capacity: This contract is established for a maximal capacity. If the number of tenants exceeds thecapacity, the owner has the right to refuse the extra persons. Every modification or breaking of the contract will be at the tenant’s charge.

Article 13 – Insurances: The tenant is responsible for all the damages happening because of him. He has to own an insurance policy to cover these different risks.
Article 14 – Charge fees : At the end of the stay, the tenant has to pay the charges not-included in the price. The amount is calculated on the basis appearing on this contract and in the descriptive page, and a receipt is given by the owner.

Article 15 – Litigations : Any complaint related to the inventory or the changes between the descriptive and the actual place, has to be made to the Departmental Office of the Gîtes de France within 3 days after the beginning of the contract. Any other claim has to be adressed as soon as possible by mail.
